Prop. 8 Communications Denied To Gay Activists

When Proposition 8 in California changed the State Constitution to define marriage as being only between a man and a woman, the gay activists went on the offensive to overturn the vote. Part of their attempt included seeing internal campaign communications among Prop. 8 supporters in the hopes that the backers of the ballot measure were trying to create "discriminatory animus" against homosexuals. A federal appeals court panel denied the gay marriage supporters' demands to see the internal campaign communications among Proposition 8 supporters, ruling that to do so would violate the 1st Amendment's guarantee of freedom of association.

The decision will continue to enable Proposition 8 to remain in place as a legal amendment to the state Constitution. However, cases by gay activists will continue to be put forward. The fight to protect the sanctity of marriage in California is not over yet.
