"Birthers" ask if Barack Obama is even eligible to be President of the United States. The argument varies from one theory to another. Some folks that question the eligibility of Obama believe that Obama was born in Kenya, while others proclaim his birthplace does not matter because his father was not an American citizen in the first place. Various legal suits have been brought to the courts, and the question as to whether or not Obama is eligible to be President as a Natural Born Citizen is sometimes alluded to on Conservative Talk Radio, and laughed at by liberal commentators and bloggers.
The hope of those that question Obama's eligibility is that eventually one of their cases will work its way to The Supreme Court, and the court will find Obama ineligible, therefore nullifying all of the legislation he has signed, thus reversing the damage by this hard left individual inflicted on the nation.
The courts have used "standing" as a tool to keep the legal challenges against Obama's eligibility out of the courts. Case closed, no more to say - or is it?
U.S. Supreme Court Justice Clarence Thomas told a House subcommittee that when it comes to determining whether a person born outside the 50 states can serve as U.S. president, the high court is "evading" the issue.
Thomas' unexpected words were a part of his testimony before a House appropriations panel discussing an increase in the Supreme Court's budget earlier this week.
When subcommittee Chairman Rep. Jose Serrano, D-N.Y. made an off-hand reference to the issue, saying "I'm still waiting for the [court decision] on whether or not a Puerto Rican can run for president of the United States," Thomas eventually replied, "We're evading that one," answered Thomas, prompting laughter in the chamber.
