Oh, come now, Professor, don't you think you're at least exaggerating a smidge? I mean, as the old saying goes, "What could possibly go wrong?":
Democrat Senator Ed Markey of Massachusetts has introduced legislation calling for the government to investigate "hate speech" on broadcast, cable, and Internet outlets — a bill that is raising concerns from First Amendment advocates and constitutional experts.
Harvard law professor Alan Dershowitz called the enactment of hate speech laws a "dangerous trend."
"I have never in my life seen a successful effort to define hate speech that does not interfere with rights of free expression," Dershowitz told Newsmax. "It is a worthy effort, but my prediction is that it either leads to the conclusion government cannot do it, or that they will do it and that will infringe on First Amendment rights.
"Governments are trying to also make changes to hate speech law and debating the issue in Canada, at the United Nations, and even right now in Israel. It is a worldwide trend, but it is a really dangerous trend," Dershowitz said.Well, okay, I guess there are a few problems with the Markey bill.
1) "Congress shall make no law....abridging the freedom of speech...." So says the First Amendment to the United States Constitution. I don't see any qualifiers attached to it, either.
2) Has anybody asked Senator Markey who it is that gets to define what "hate speech" is? Because if it's the government in general, and animals like Ed Markey in particular, then I'd have to refer him back to point #1.
3) If anybody seriously believes that the Markey bill, were it to become law (which it won't, at least not legally - Barack Obama does still have his pen and his phone, though....), wouldn't skew its definition of "hate speech" to target conservatives, Christians, constitutionalists, Tea Partiers, Republicans, etc., then Lois Lerner has a rogue bridge in Cincinnati she'd like to sell you.
Markey's hook for this bill?:
Announcing the Hate Crime Reporting Act last month, Markey cited three killings at Jewish centers in Kansas by a white supremacist in April, and said in a statement it is "critical to ensure the Internet, television, and radio are not encouraging hate crimes or hate speech that is not outside the protection of the First Amendment."
Ah, yes. Because Frazier Glenn Cross would never have shot up those two senior centers if "the Internet, television, and radio" hadn't "encouraged" him to do so. And who, by Regime definition, are the only people who engage in "hate" speech? Why, conservatives, Christians, constitutionalists, Tea Partiers, Republicans, etc. How convenient.
That "white supremacist" is a Democrat, BTW.
Ken Paulson, president and CEO of the First Amendment Center, told Newsmax that Markey's bill "strikes me not only as misguided, but also probably a waste of time.
"Studying the prevalence of hate speech on the web or in any other media is a perfectly legitimate examination for academics who want to explore that issue. It is an entirely different matter when government seeks to do that because inevitably they will act on the report," Paulson said.
Paulson asserted that even if the report requested by Markey comes back finding a prevalence of hate speech, the government cannot do anything about it as a consequence of First Amendment protections of even the most vile speech.
"There always is the concern when Congress studies an issue because there exists that temptation to act on the results," Paulson said. "If someone posts on the Internet that we should go string someone up and they name that person, and encourage action, that is a different matter. But hateful speech is absolutely protected by the First Amendment."
However "hateful" is defined. Filth like Ed Markey should be glad about that. Otherwise, the entire American Left would have to be muzzled.
Not that that isn't sorely tempting, but still....
ReplyDeleteMassachusetts proposed, "hate speech" laws are nothing but an entry point for left wing fascism to build a firm foundation upon in society. It's the path to eliminating shock jocks and conservative media who are commenting on possible reasons why society is going backwards or why politics isn't more forwards.
Vested interests on the left do not care at all about hate speech...but if they can incite inflammatory comments in others...or monitor it... as it goes through the vehicle of media they can pounce.
Discover it through the vehicle that is not left wing even better the imbalance. They can attack everyone from high to low....from the caller on the street to the shock jock...through to many Fox programs that seek to generate genuine debate if this went national.
This reminds me of an essay I wrote on witchcraft in Europe at Murdoch University. I built an argument from sources that it was not religious authorities in the majority that were accusing people of being witches but often community men and particularly women. They accused people in their villages they didn't like...that they wanted taken out of the picture of being witches.
My feminist lecturer failed my essay.
I appealed based on the credibility of my sources and my mark was, on appeal, taken to a Distinction.
My argument in my essay was sound. The accuser and the accused were living in a society where education did not exist beyond the little that was communicated by custom or the church.
The central argument in my essay was that it was the operation of town politics that was the main vehicle of drownings for being found guilty of witchcraft. If a person could not say the Lord's prayer, along with defend oneself against a string of fabricated accusations they were drowned as witches.
And so all you had to do is learn the Lord's prayer fervently... and to keep remembering it and then accuse your neighbor of being a witch. If your community enemy could not say the Lord's prayer along with acceptable answers to the fabricated accusations on most occasions you would be successful in having them drowned.
You can see where this is going.
I can see these educated left wing fascists accusing people from disadvantaged, right through to bible belt communities of hate speech. Their attacks and accusations can go right to the more educated and political members of the community with religious beliefs...of promoting what they and left wing judges determine as hate speech...of not being able to say their, "legal prayer of acceptable speech."
All they have to do is gender...class...religious or...race bait like Obama is doing so often to get the Democrat base out to vote, and a whole lot of people can be drowned out or eliminated from engaging in debate.
This is a whole new creation of a left wing fascist "inqusition" that can be used at the highest level of politics ....across the media...online...right down to "village" discussions in the community.
This is just another frustrated effort by left wing fascists after failing to get FCC monitors in the newsrooms to assert control...a foundation upon which to do their "purging."
I find it quite ironic that it was in Salem Massachusetts that witches were burnt at the stake.
Let the accusations of witchcraft begin.

Again...in this article below there is a rightly concerned citizen that agrees with the march of left wing fascism in America in the area of anti-islamic art ruled as hate-speech. We see an emerging trend of left wing fascists teaming up with Jewish and Muslim groups to try and silence the centre and right of politics.

Although I disagree with Gert Wilders I find it strange that the Jewish community is so paranoid that its preferred position is to gravitate towards political parties with left wing fascist sentiment at their centre as we see with their 80% electoral support for Democrats.
All Americans whether Jews....Christians...Hindu...Buddhist or athiest need to realise that Democrats are the party that has pushed for FCC monitors in our newsrooms, FEC leaks that show a government desire to censor conservatives and put in "hate speech laws" which is the 21st equivalent of a priveledged few calling people "witches." There is message that Jews...Muslims and liberals need to heed. Don't seek to close down free speech through your business interests or the law or politics or you are at risk of being fascists yourself and it will be the end of our Democratic peace.
