Sex Offender Law Unanimously Overturned in Murrieta, California

Murrieta - In a unanimous 5-0 vote, the Murrieta City Council voted to repeal an ordinance that made it illegal for sex offenders to loiter near areas frequented by children. A lawsuit filed against the city by registered sex offender Frank Lindsay from San Luis Obispo forced the hand of the council. Lindsay has also filed suits in other California cities targeting similar ordinances. The cost of defending the City of Murrieta against the lawsuit would have been between $50,000 and $75,000, with the chance of winning, based on other rulings regarding similar cases, “remote.”

Lindsay’s lawsuit accuses the city of having rules regarding registered sex offenders that are more restrictive than what is allowed by State Law.

Legislative action at the State level may follow in the hopes of providing cities with more local control over the issue of registered sex offenders.
