Intolerant Jackass Act Targets Free Speech

By Douglas V. Gibbs

Proponents of a ballot measure that targets anyone who proposes anti-homosexual laws, calling for these folks to undergo State sponsored "sensitivity training" and donate $5,000 to a pro-homosexual organization, have surpassed their first hurdle, and can now begin collecting signatures. The name of the proposal is the "Intolerant Jackass Act," and is a response to an initiative called the “Sodomite Suppression Act,” a proposal that currently remains in limbo.

Attorney General Kamala Harris sought a court injunction rescinding her obligation to prepare a title and summary for the "Sodomite Supression Act," which received national attention and backlash for its call for captial punishment for homosexuality.

Harris said in March that the Sodomite Supression Act “threatens public safety, it is patently unconstitutional, utterly reprehensible, and has no place in a civil society.” She, however, did not hesitate to prepare a title and summary for the Intolerant Jackass Act. The freedom to oppose the homosexual agenda, no matter how reprehensible such a stance may seem to Harris and her gay agenda allies, as shown by Harris' quick action, reveals that suppressing freedom of speech when it offends certain groups is not a taboo for California's top lawyer.

In response to the proposed Sodomite Suppression Act, state Assemblymen Evan Low, D-Campbell, and Richard Bloom, D-Santa Monica, introduced state legislation that would increase the filing fees for proposed initiatives from $200 to $8,000 to prevent frivolous filings. The bill passed the Assembly in May and was sent to the state Senate for consideration.
