Constitutionally, there is a lot wrong with our federal judiciary. Judges are supposed to be apolitical, and they are only supposed to apply the black letter of the law to the cases they hear. If they have a concern about the law, or the actions of the President, then they may write an opinion, but the court is not supposed to have any kind of enforcement power behind that opinion. Also, before we get into any "co-equal" branches discussion, let's remember that from the point of view of the Framers of the Constitution, the federal courts are supposed to be the weakest of the three branches.
However, what we have seen is a judicial branch that has evolved into the most powerful voice in politics.
President Trump, it seems, won't stand for it.
After President Trump criticized a federal judge who ruled against the administration's asylum policy this week, calling U.S. District Court Judge Jon Tigar "an Obama judge," Chief Justice John Roberts responded with his own rebuke.
"We do not have Obama judges or Trump judges, Bush judges or Clinton judges," Roberts responded to Trump in his statement.
"What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them."
Roberts is right, and wrong. The justices are not supposed to be Obama judges or Trump judges, but the reality is, they are. That's why the Kavanaugh hearing was such a big deal.
That has been our problem for a long time. Ideology has been guiding our judges for a very long time, and it seems the Obama judges have their knives out for our current president. Every time he does something within the law, they say its not. Every time he does something that he has constitutional authority to do, they say he cannot.
Justice Roberts words are in line with the way it is supposed to be, but the reality is, Trump is right on this one. Regardless of how things are supposed to be, we have a liberal left oligarchy in the court system, and they have been doing everything they can to delay and obstruct our president. . . in spite of the Constitution.
