And they won't be the first:
A bill set for fast-track passage in the South Carolina Senate would effectively nullify Obamacare in that state – and could become a model for other states fed up with the president’s signature healthcare law....
If the bill becomes law, South Carolina will be the first state to exempt citizens and businesses from all participation in the [Una]ffordable Care[-Less] Act, the Daily Caller reported.
The bill's main component prohibits agencies, officers and employees of the state from implementing any provisions of the [Una]ffordable Care[-Less] Act, leaving implementation entirely in the hands of the federal government, which, Davis contends, lacks the resources or personnel to carry out the programs it mandates.
"What the Supreme Court said in Printz v. United States is that states are not merely political subdivisions of the federal government, to carry out what the federal government does; they are sovereign entities," Davis told the Daily Caller.
"Congress can pass laws, but it cannot compel the states to utilize either their treasury or personnel to implement those federal laws."
Now you all know me, so you know my instinctive reaction to such a story - namely, one of extreme skepticism. Appreciation of the sentiment, but highly dubious that such a strategy can succeed in practice because of the Obama Regime's open and rampant lawlessness. What's to keep the White House from simply forcing ObamaCare on South Carolina, using federal troops if that's what it takes? How would Governor Nikky Haley and Palmetto state Republicans be able to resist the literal forces at King Hussein's command?
Instead, my reaction is one of intrigue. It's not so much a throwing down of the gauntlet as it is a calling of tyranny's bluff, with South Carolina as the canary in the coal mine. O has been doing whatever the hell he wants, Constitution and law be damned, in an orgy of soft tyranny; now he faces a situation where a state is reasserting its sovereignty and telling him to, you should pardon the expression, go slam his nuts in a drawer. He's actually being directly challenged. If he lets South Carolina get away with defying his power, other states will follow suit and ObamaCare implodes, not with a bang, but a whimper, like a puppet's strings being cut. But to put down this rebellion, soft tyranny will not be enough; The One is going to have to be more iron fisted than he's ever been before. Ruthless. Even brutal.
It's a turning point. Either South Carolina is mercilessly crushed like Hungary in 1956 and Czechoslovakia in 1968, or the Obamidency is effectively over.
Stay tuned.
I think its an interesting way to challenge it.
ReplyDeleteHow they will PAY for it... who knows.
Something that has always bothered me though is this...
The supreme Court ruled that the Government can NOT force you to buy something.. and then turns around and says that you can PUNISH them with taxes (and then jail time if you dont pay it) for NOT buying it...
how is that different?
Either they CAN force you to by something and punish you (with fines/taxes and jail time) for not buying it...
or they CANT force you to buy something and STILL punish you (with fines/taxes and jail time) for not buying it...
Isnt that the same coin?
