Myth #23: The Progressive Income Tax Rate is Constitutional Because of the 16th Amendment

This is the Twenty-Third Myth in the series: 25 Myths of the U.S. Constitution.

Note: These articles later were updated and combined into my first book: 25 Myths of the United States Constitution.

By Douglas V. Gibbs

The income tax became a part of the American landscape in 1913 with the ratification of the 16th Amendment. There is some argument over whether or not the 16th Amendment was properly ratified, and I believe there may be some merit to that argument, but the reality is that the 16th Amendment has been in force since February 3, 1913, so we must treat it as if it is a fully ratified law.

The original intention, or at least this was the argument of the proponents of the amendment, was to pay off the debt incurred by the United States as a result of the Spanish-American War. The proponents of the amendment, in order to convince those not too sure about instituting an income tax, promised it to be only voluntary, and temporary, and would be repealed once the national debt was paid off. The results that followed were hardly as promised, showing us once again that the age old truth is in fact true - politicians lie.

An income tax is a direct tax, which is something the founders determined should not be a part of the American system. In fact, it was direct taxation like the Sugar Act, and the Stamp Act, that roused the colonists to rebellion.

The progressive income tax rates have become a system in place the politicians have used to campaign for office. Two schools of thought have emerged regarding the progressive tax rates. Democrats tend to support increasing taxes on wealthier Americans, thus further widening the gap between the lower tax rates and the higher tax rates; Republicans traditionally support reducing that gap, arguing that the rich are the producers and achievers of society, and such a tax break for the richer members of society encourages economic growth.

The ten steps to creating a communist system from the original ten planks within the Communist Manifesto written by Karl Marx in 1848 include a progressive tax rate. The second plank of the Ten Planks of The Communist Manifesto reads: A heavy progressive or graduated income tax. That communist step to create a communist society comes right after the abolition of private property, and right before the abolition of all rights of inheritance.

In step with Karl Marx, widening progressive income tax rates redistributes more money from the upper income to the Middle Class.

Historically, reducing the top marginal rates, such as Presidents Kennedy and Reagan did, spurs growth. Lowering the top rates gives the top earners an incentive to invest in innovation, expand their businesses, and spend on consumer items, all of which grow the economy and increase revenue.

Raising the top brackets creates uncertainty, and disincentivizes the producers and achievers from investing, and growing their businesses.

From the point of view of the Constitution, progressive tax rates does something else, as well. Expecting one group to pay a higher percentage than another group by the government is unequal treatment of the citizens. Not only is widening the gap between the tax rates a method to redistribute income, capital and benefits (like health care) from the upper income to the Middle Class and poor, but the unequal treatment of the different income classes is in violation of the Equal Protection Clause of the Fourteenth Amendment.

The Equal Protection Clause was designed to ensure the emancipated slaves were treated as individuals, and that these individuals were subject to the same laws as all other citizens. No individual or group could have special legal privileges, nor be treated unequally in the eyes of the law.

In an active redistribution agenda, wealthier Americans are being singled out, or are being treated differently than the rest of the population, because they are expected to pay a higher income tax rate. If the rate was flat across the board the rich would still pay more taxes by the sheer fact that they have larger incomes, so in reality it is not about paying their "fair share."

The use of taxes as a punishment against success is unconstitutional in other ways, as well. For example, taxes against specific parts of the private industry that are essentially designed to punish an industry constitutes a bill of attainder. An example of this kind of policy was the proposed $90 billion bank fee (or tax). The banks claimed the proposed tax to be an unfair bill of attainder. The constitution bars bills of attainder in Article I, Section 9. While members of government may have seen such a policy as being nothing more than making the banks "pay their fair share," and keeping the banks in check, such a policy was in reality yet another attempt to punish the upper incomes with higher taxes for redistribution, making such a policy unconstitutional twice. No bills of attainders are allowed by the Constitution, and a segment of the American private sector through the bank fee policy would be singled out and treated unequally by the federal government - in violation of the Equal Protection Clause of the Fourteenth Amendment - making the policy unconstitutional a second time.

The Sixteenth Amendment may allow the existence of an income tax, but the amendment does not specifically enable a progressive income tax rate, and the very existence of a progressive income tax rate is, as stated, in direct violation of the Fourteenth Amendment - making the progressive income tax rate unconstitutional.

Corporate Taxation, and a $1.5 Trillion Tax Hike

By Douglas V. Gibbs

There seems to be a belief out there that big corporations don't pay any taxes. GE is proof positive. . . but they are in the liberal left's pocket, so of course they get preferential treatment.

The federal government has been giving money to failures like Solyndra, and bailing out failures, to buy votes, and try to pick the winners of society. Problem is, the beneficiaries of the government's good will wind up bankrupt. Such mercantilism is not how a free market is supposed to run. Failures are failures, and should fail. Other companies will pick up the pieces and grow as a result. The winners will win as a result of capitalism, not government favors.

Simply put, the liberals in control of the federal government are mercantilists that, despite their strategies they think will grow the economy, are bankrupting and ruining the economy of this country. The federal government is not some benevolent entity. The federal government is not a good money manager. The problem is not the corporations, as the federal government claims. The problem is the federal government.

People are overtaxed as it is, and the government is spending more than it should. If the government only spent constitutionally, we wouldn't even need an income tax because total government spending would be about 5% of GDP.

Cut spending, reduce it to constitutional levels, leave the State issues to the States, and the income tax will become unnecessary, and it would be reasonable to repeal the 16th Amendment.

The problem is, the tax system isn't even what it used to be. The original idea was to raise revenue to pay down the costs of the Spanish-American War. The income tax was supposed to be temporary, and voluntary. The income tax, however, under the management of the establishment, has evolved into something else. It is no longer about raising funding to run the government. The income tax, complete with the IRS as its militant arm, and its out of control tax code, exists as it does now for a whole new reason: for the purpose of creating political patronage.

Forty-seven percent of Americans who work pay no income taxes. The top 10% are paying close to 50% of all income taxes. The liberals will tell you the rich don't pay their fair share when it is the rich who are the ones supporting this country right now. Obama, however, does not believe that anyone should do that well, unless they are a part of the political elite. He has $1.5 Trillion in tax hikes ready to roll, and they are designed to take aim at the wealthy. Since Obama has taken office the number of millionaires has dropped by 39%. That is why companies are sitting on money, and why nobody is hiring. The liberal left is attacking the producers of this nation, and there is uncertainty. The rich are the ones that produce jobs, and grow the economy, and they are under attack. The last thing they want to do is invest, or attempt to grow their businesses.

Instead of growth, Obama's Keynesian economics has brought us a national debt that is skyrocketing out of control. The liberals have targeted the wealth creators, and in turn wealth is being destroyed. Socialism and utopian redistribution is not bringing about a more socially just future - the policies are destroying American prosperity. The government is out of money, and they are printing money at a rate that is devaluing the dollar in such a rapid manner, that it is bringing the United States rapidly to a fate not unlike what Europe is experiencing now.

In a panic, they are going the only place where they think the money is - the rich - and they are simply taking it from them.

The tax code is being used to punish the producers, getting even for what the Left believes to be an unfair society. The liberals have no interest in creating new jobs, because lowering taxes would encourage growth. In 2009 Obama admitted that raising taxes in a recession is bad, yet now he wants to do it.

Tax increases were always a part of his agenda, despite his rhetoric as a candidate, and early on in his presidency.

Tax collection is down because more and more people are out of work, meaning that less and less people are paying taxes. The corporations, individuals, all of them are paying less as the government spends more. The federal government is printing and borrowing and spending even more and more.

For every corporation taxed out of existence or taxed out of profit, that's another corporation for which you have no chance of ever getting a job. Whether you think the corporations are evil, can't be trusted, or whatever, the fact is it is them that is needed to create jobs, and grow the economy.

Corporations pay a 35% tax rate in the United States. It's the highest in the world. Then, after they pay their corporate tax, the shareholders who cash out their investments pay a capital gains tax on top of the corporate income tax already paid by the corporation. And then, the people who work for the corporation pay an individual federal income tax on top of what the corporation already paid with its corporate income tax. Dollars made by a corporation are taxed a number of times.

The Left have decided corporations are the enemy, except the ones that play ball, or serve the Left's political purposes (like Solyndra). The Left has done all they can to demonize the corporations, accuse them as much as possible, and they have even convinced people that they don't pay taxes. The people that work at these companies pay taxes. The corporations do too.

But, in reality the corporations don't really pay taxes. The money they lose in taxes they make right back up in the price of the product you buy or pay for. In other words, the Left wants to tax the rich, and hammer the corporations, and in the end the cost will be passed on to the consumers - which means when they tax the rich, they are really taxing the consumers (largely the Middle Class and the poor).

The Left does this for control, but they call it social justice. They demonize the oil companies, but need gas to go anywhere. They demonize the insurance companies, but dump their own investment dollars into them.

Liberals love the products and services that businesses provide, but they demonize those companies because it makes them feel good to hate them - because they've been taught to do that.

They have no sense to understand that the things they use are available because of the corporations - a free market. They use the technology, but they claim to hate the corporations, and want to punish them with more taxes so that they can give the money to the rest of the people through government programs - but does that create more jobs? Does that truly help the slaves on entitlement programs?

No, of course not. But for the political elite, it is truly about none of those things, anyway. For them, it is all about buying votes, and demonizing the corporations as their hand is behind their back, with their fingers crossed.

Gun Ownership Is A Virtue

Guns, in the hands of evil men, can be used for evil doings. Guns, in the hands of good men, keep evil at bay.

By Douglas V. Gibbs

My shirt says "American Militia." The image on the back is a shield covered by an American Flag, a bald eagle, and two crossed AK 47s - with "We The People" draped over the top. Though I don't have an AK 47 (but I would love to own one), I have plenty of fire power should I need it.

I remember in March of 2010 when I was at the Tea Party Express rally in Searchlight, Nevada a news crew from Ireland asked me if I was willing to take up arms against my government.

"If necessary."

We mustn't forget that it is exactly this kind of tyranny we are currently up against the Founding Fathers warned us against. About the only thing they haven't done is outlaw voting.

The liberal left would like to disarm us. My mention of the AK 47s probably has a bunch of them freaking out as they read this. Fact is, gun violence goes down when the population is armed, because the potential victims can fight back.

In Britain, for example, after gun regulations pretty much disarmed the public, the gun violence increased drastically.

Armed citizens are free. Unarmed citizens are subjects.

"Weapons compound man's power to achieve; they amplify the capabilities of both the good man and the bad, and to exactly the same degree, having no will of their own. Thus we must regard them as servants, not masters - and good servants to good men. Without them, man is diminished, and his opportunities to fulfill his destiny are lessened. An unarmed man can only flee from evil, and evil is not overcome by fleeing from it." -- Colonel Jeff Cooper, as quoted in "Survivors: A Novel of the Coming Collapse" by James Wesley, Rawles.

I am still surprised at how many ignorant people there are out there that believe that taking guns away from law abiding citizens (or heavily restricting such fire arms) is a good thing.

Give me an AK, and I guarantee nobody is ripping my place off.

Green Technology Debacle More Than Solyndra

‘Green Jobs’ scam much bigger than Solyndra

By Howard Rich

At the heart of Barack Obama’s socialist agenda has been the myth that government-subsidized “green jobs” would stimulate a broad-based economic recovery.

“We need to invest in the jobs of the future and in the industries of the future, because the country that leads in clean energy and energy efficiency today … is going to lead the global economy tomorrow,” Obama said last March. “I want that country to be the United States of America.”

Wishing didn’t make it so, however – nor did $93 billion in “green investment” included in Obama’s failed “stimulus.”

In an effort to get to the bottom of the “green jobs” scam, this month the U.S. House of Representatives began investigating a $535 million federal loan awarded two years ago to Solyndra – a Fremont, California-based solar panel manufacturer which filed for bankruptcy last month (resulting in 1,100 lost jobs).

Of immediate interest to lawmakers is whether the Obama administration pressured officials into prematurely approving Solyndra’s loan so that Vice President Joe Biden could participate in a “major Recovery Act announcement” with the company. Recently-uncovered emails lend credence to this theory, and the Obama administration is already neck deep in denials.

But the Solyndra debacle isn’t just about taxpayers shelling out half a billion dollars on a vice presidential photo opportunity, it’s about the broader failure of command economic intervention – “green” or otherwise.

“These jobs are gonna be permanent jobs,” Biden said in announcing the Solyndra loan. “These are the jobs of the future. These are the green jobs. These are the jobs that won’t be exported.”

Nine months later Obama himself visited the company – touting Solyndra as a “stimulus” success story.

“The true engine of economic growth will always be companies like Solyndra,” he said.

Obviously Obama is flat wrong on that point. The true engine of growth is free market – a lesson Solyndra found out the hard way. With cheap Chinese solar panels flooding the market and a corresponding reduction in global demand, this “industry” was on an unsustainable course – not unlike the government subsidizing its expansion.

A month before Solyndra went belly-up, Massachusetts-based Evergreen Solar – which received $58 million in taxpayer aid – also declared bankruptcy. Months earlier, the company had moved 800 manufacturing jobs to China.

“This is one of the most oversupplied industries I’ve ever seen,” an energy industry analyst noted at the time. “Evergreen is just the tip of the iceberg.”

Losing “green jobs” to overseas competitors has been a hallmark of the Obama “stimulus.” Last February, an American University report revealed that 80 percent of the $2 billion appropriated in the bill for wind power projects had gone to foreign companies.

“Most of the jobs are going overseas,” researcher Russ Choma told ABC. “According to our estimates, about 6,000 jobs have been created overseas, and maybe a couple hundred have been created in the U.S.”

Meanwhile, America is littered with empty “green jobs” promises.

In Nevada, one solar company received $55 million in federal and state tax credits – but hired just five new employees, while $61.5 million in “stimulus” funds were spent on geothermal projects that created only 25 new jobs. In Seattle, a $20 million weatherization grant that was supposed to create 2,000 jobs and retrofit 2,000 homes wound up producing only fourteen jobs and retrofitting three homes.

Even if we accept the Obama administration’s rosy estimates that 225,000 jobs have been “saved or created” as a result of this $93 billion investment– that’s still a price tag of more than $410,000 per job.

Taxpayers certainly deserve a full accounting on the Solyndra scandal, but it would be a mistake to assume that this scam is limited to one bad loan for $535 million. The true cost of government’s “green jobs” scam is much larger than that.

Founding Truth of the U.S. Constitution

Myth #22: The Federal Government has Implied Powers that are not Specifically Enumerated by the Constitution

This is the Twenty-Second Myth in the series: 25 Myths of the U.S. Constitution.

Note: These articles later were updated and combined into my first book: 25 Myths of the United States Constitution.

By Douglas V. Gibbs

When one studies the United States Constitution, and also studies the various opinions regarding the U.S. Constitution, one discovers the existence of two schools of thought when it comes to the authorities of the federal government. One contends that all federal powers are expressly given, or enumerated, by the U.S. Constitution (primarily in Article I, Clause 8, and all subsequent Amendments). The second school of thought recognizes two different types of powers in the Constitution: Expressed powers and implied powers.

Expressed powers include the power to tax, maintain a military, coin money, establish post roads and post offices, and to establish uniform rules of naturalization.

Those that do not agree with the strict constructionist view of the U.S. Constitution will argue that there are more powers granted to Congress that you can find within the body of the Constitution and its amendments. These are implied powers, which means that there are powers beyond those enumerated that are given to Congress so that they can write laws to make sure what needs to happen happens. In other words, those that believe in the existence of implied powers argue that such powers add to Congress's expressed powers.

Implied powers, according to those that support this concept, relate specifically to the Legislative Branch, but actually all branches have some form of implied powers.

The Constitutional argument used to support their belief in the existence of implied powers is in Article I, Section 8, Clause 18, also known as the "necessary and proper clause." The clause reads: To make all law which shall be necessary and proper to carrying into execution the foregoing powers, and all other powers vested in this Constitution in the government of the United States, or in any department or officer thereof.

The language of this clause, however, actually denies the existence of implied powers, for the clause specifically states that the laws necessary and proper must be passed in order to carry into execution the foregoing powers, and all other powers vested in this Constitution.

Foregoing powers means the powers expressly granted preceding this clause. All other powers vested in this Constitution means any other powers granted by amendment.

Also notice the word "vested." Vested means "legally transferred." If the powers are legally transferred, they must be transferred from someplace. If you read Article I, Section 1 and the Tenth Amendment, it becomes apparent that the original possessors of the powers granted to the federal government is the States, therefore the laws must be in accordance with those powers granted, and any new powers must be obtained through the amendment process (Article V) which does not reach fruition until the States ratify the request with a vote of 3/4 of the States.

So, any laws passed by the federal government must be in line with their authorities from the Constitution itself, which means they cannot possess any implied powers that do not find their foundations in the express powers granted.

Those that support the concept of implied powers will also argue that Article I, Section 7 of the Constitution grants the concept of implied powers as they relate to committees, subcommittees, conference committees, limits on debate, how a law will be introduced, or any other details. The assumption is that those procedures were created out of the implied power of Congress. However, the ability for the Houses of Congress to make their own rules is not an implied power, but a specific enumerated power provided for in Article I, Section 5, Clause 2, where it establishes Congress's allowance to make their own rules of operation.

Another assumption of an implied power is the power of the military draft. Those that support the concept of implied powers will tell you that the military draft is an implied power of Congress to raise and maintain an Army and Navy. However, there is no place in the Constitution that actually allows for a military draft, so as a strict constructionist, it is apparent to me that the military draft is actually an unconstitutional action.

Thomas J. DiLorenzo, in his book "Hamilton's Curse," explains that implied powers were an invention of Alexander Hamilton, a federalist that believed in a more centralized governmental system. DiLorenzo wrote:

Hamilton also invented the myth that the Constitution somehow grants the federal government "implied powers." "Implied powers" are powers that are not actually in the Constitution but the statists like Hamilton wish were there. As Rossiter pointed out, "One finds elaborations of this doctrine throughout his writings as Secretary of the Treasury." The most notable articulation of this idea can be found in Hamilton's Opinion on the Constitutionality of the Bank of the United States. He wrote this report in 1791, while serving as treasury secretary. President Washington had asked both Hamilton and Jefferson for their opinions on the subject. In his opinion, Hamilton wrote that "there are implied, as well as express powers [in the Constitution], and that the former are as effectually delegated as the latter" . . . He added, "Implied powers are to be considered as delegated [to the federal government] equally with express ones." A nationalized bank, he went on to argue, was one of those implied powers.

Jefferson vehemently disagreed, arguing that the express powers delegated to the federal government in Article I, Section 8, of the Constitution (providing for the national defense, coining of money, etc.) were expressly stated because they were the only powers delegated to the federal government by the sovereign states that ratified the Constitution. Any new powers, Jefferson believed, could be delegated only by a constitutional amendment. He realized that such a doctrine as "implied powers" would essentially render the Constitution useless as a tool for limiting government if the limits of government were simply left up to the imaginations of ambitious politicians like Hamilton. . . the shock troops of the Federalist Party - federally appointed judges - would use Hamilton's arguments to essentially rewrite history and the Constitution. Thus was "liberal judicial activism" born.

. . . George Washington had condemned the notion of a "living constitution" in his Farewell Address (which, oddly enough, is said to have been at least partly ghostwritten by Hamilton). In that address President Washington said, "If in the opinion of the People, the distribution of modification of the Constitutional powers be in any particular wrong, let it be corrected by an amendment in the way the Constitution designates. But let there be no change by usurpation . . . the customary weapon by which free governments are destroyed." Hamilton's theory of implied powers ignored this warning, laying the template for generations of lawyers who would use the courts, rather than the formal amendment process, to essentially render the constitutional constraints on government null and void.

Not only were there supposedly "implied" powers in the Constitution that only the wise and lawyerly like Hamilton recognized (but that were foreign to James Madison, who like Jefferson was a strict constructionist) . . . unconstitutional powers would magically become constitutional, in Hamilton's opinion. Taken to logical ends, this argument implies that any action of the government would be de facto "constitutional" by virtue of the fact that the action occurred. This is how Hamilton viewed the Constitution - as a potential blank check for unlimited powers of government.
(Thomas J. DiLorenzo, Hamilton's Curse, New York: Three Rivers Press, 2008, pages 26-29.)

Gold Bullion transactions are illegal for All U.S. citizens

By Douglas V. Gibbs

A couple of months ago the Dodd-Frank Act make Over The Counter Bullion transactions bought and/or sold on Leverage, Finance, and/or Margin illegal for all U.S. citizens, thus deepening the government's control over bullion. Buying physical Bullion and taking delivery, for now, is still legal.

As is normally true of progressives, however, this is only the camel's nose in the tent. Liberal control through government mandate over the people starts with small, innocent looking regulations, often attached to some "good intent," or feeble attempt at "fairness."

The good intent, in this case, is to protect you from yourself, because Americans must be protected by the all benevolent federal government from high risk trading.

The attempt to protect American consumers from their own alleged stupidity (because after all, only the political elite knows what's best for everyone, right?) is being accomplished through federal legislation, including the "Dodd-Frank reform & Consumer Protection Act".

The Dodd-Frank "Bill" was Introduced by The Obama Administration as Government Control and/or Regulation to prevent failed institutions like: AIG, Lehman Brothers and Bear Stearns, who dealt in Risky Trading of OTC "Credit Default Swaps" and "Toxic-Mortgage Backed Securities".

The problem is, Over The Counter Bullion did not play a role in the Collapse of AIG, Bear Stearns or the Economy.

The Bullion Ban is simply a federal power grab, and riches grab, and the fear of a cashing out of gold by consumers when the high looks to be topping out.

If the agencies involved, like the Commodity Futures Trading Commission (CFTC), got all they wanted, the Ban would include "all" Bullion transactions, including those not deliverable within 48 hours.

The federal government has been held back from complete control over bullion, so far, by the lobbying of financial firms (sometimes I truly regret allowing my securities license to lapse a couple decades ago).

The Dodd-Frank Act enabled the federal government to gain "a foot hold" over Retail Bullion Transactions, allowing them to push for a shorter delivery time in the future, which would eventually make all bullion transactions illegal by default.

With a fight over the details of CFTC approved futures contracts, right now the federal government is held off from full control, but the fed is working to change that.

The political elite that currently has a stranglehold in government are working to completely abolish the Over The Counter Bullion market, while tracking and taxing Privately Held Bullion, and controlling any all transactions made in the market.

Ultimately, this could lead to FDR's dream: a complete ban and confiscation of all gold bullion. Corrupt, and bankrupt, centralized systems bent on full control over the people do these kinds of things. History proves it. All tyrannies in history have confiscated the gold from their Citizens.

The most recent U.S. Gold Ban took place in 1933 (good ol' Marxist liberal progressive nightmare, Franklin Delano Roosevelt), during the Great Depression. It was Illegal for U.S. citizens to Buy ANY Bullion for 42 years (Dec. 31, 1974).

And the liberals are willing to do this unconstitutionally, without the approval of Congress, through an Executive Order (which is believed, thanks to Lincoln's unconstitutional precedent, to be completely legal during conflict due to a President's "War Powers", or during a national financial crisis).

Remember Rahm Emanuel's fateful words about crisis? The liberal democrats love crises, because according to them, during a crisis the oppressive government elite can do more of the things they can't normally do.

This is why it may be prudent to get our hands on as much gold as possible as individuals. . . before the government once again bans the only thing out there still holding value.

Myth #21: Executive Orders Can Modify Law

This is the Twenty-First Myth in the series: 25 Myths of the U.S. Constitution.

Note: These articles later were updated and combined into my first book: 25 Myths of the United States Constitution.

By Douglas V. Gibbs

Executive Orders are not specifically mentioned in the U.S. Constitution. Many Americans falsely believe that executive orders, in addition to the functions of modifying how an executive branch department or agency does its job (rule change), or to issue a proclamation, can modify existing law. Modifying law, however, would need to accompany the authority to make law, and that authority rests solely with the Legislative Branch. Therefore, any executive order that modifies the law is unconstitutional. Article I, Section 1 of the U.S. Constitution grants to the Congress all legislative powers, therefore, the Executive and Judicial branches cannot make law, repeal law, strike down law, or modify law. Only Congress can.

Executive Orders are nothing new, for George Washington issued several Presidential Proclamations. Executive Orders and Proclamations, once again, are not law, but they do sometimes have the effect of statutes. A typical modern Proclamation might declare a day to be in someone's honor.

The Emancipation Proclamation had a broader effect, but did not free the slaves. The Emancipation Proclamation was not a law. It was a proclamation. It did change the course of the war, proclaiming the Civil War to be all about slavery, which encouraged the European Nations to step back in regards to their support of the Confederacy.

In line with that, we have often seen executive orders instruct the government to do no business with a country we are at war with, or to declare a day an official. . . fill-in-the-blank. In the political world, Executive orders are said to be subject to judicial review, and can be declared unconstitutional (not that the courts have that kind of power - see Myth #4). Executive orders hold no power over law, so States can simply refuse to follow unconstitutional executive orders if they so wish. Congress can refuse to follow executive orders that attempt to modify law, as well, since the Legislative branch alone is tasked with making law. Problem is, Congress has not been functioning in accordance with the U.S. Constitution, and has been allowing the executive branch to wield power it is not constitutionally afforded.

New Jersey Governor Chris Christie Considering Presidential Run in 2012

Chris Christie, New Jersey's fiery Republican governor, has continuously waved off any suggestions that he should run for President of the United States in 2012. He has argued he has much work to do in New Jersey, and he is too new to the political landscape to make a run.

Christie may have changed his mind.

Not fully conservative, then again few Republicans are, Christie's willingness to make hard decisions and face off with opponents on fiscal issues has made him popular among fiscal conservatives, and Tea Party folks seeking a candidate willing to take take on the liberal democrats unapologetically. The big man, a surprise GOP win in a traditionally blue state like New Jersey, has made tough decisions, but has begun turning around the economically dire circumstances in the Garden State.

The urging by donors and fundraisers, along with public calls for him to run, has brought Governor Christie to a fork in the road. He may enter the 2012 presidential race, after all. His decision is expected to be made public within the next few days.

In meetings among top Republican donors, it has been suggested that Christie seemed inclined to enter the race but said he needed more time.

Christie suggested to an audience at New Jersey's Rider University that the current GOP candidates are not answering the public's appetite for real leadership.

"I think what the country is thirsting for, more than anything else right now, is someone of stature and credibility to tell them that and say, 'Here's where I want us to go to deal with this crisis,'" Christie said. "The fact that nobody yet who's running for president, in my view, has done that effectively is why you continue to hear people ask Daniels if he'll reconsider and ask me if I'll reconsider."

Conservative doubts about Perry and Romney, and Bachmann's inability to keep pace with the two leaders, has created a window of opportunity for Christie that backers say he needs to take advantage of.

U.S. Target for Falling Satellite

By Douglas V. Gibbs

Death, taxes, and falling satellites. What goes up, must come down. Perhaps slower than originally thought, but a six and a half ton Upper Atmosphere Research Satellite (UARS) is falling to Earth, and at this point it looks like it may possibly descend somewhere above the United States.

The forecast was that the satellite would tumble out of the sky today, and miss North America entirely, but the descent of the craft from the heavens is moving slower than originally expected, and the vessel will probably enter our sky this weekend.

Chances are, according to NASA officials, that the entire spacecraft will burn up on re-entry, but the possibility that debris will survive and crash on American soil cannot be discounted. With the changing trajectory, no one seems to be entirely sure what the spacecraft will do.

If parts of the NASA spacecraft survives re-entry, NASA suggests those surviving pieces number up to twenty-six, the heaviest of those falling pieces of debris weighing about 300 pounds. However, the odds that one of those falling pieces of the satellite will strike Earth and cause injury are about 1 in 3,200. The chance of the chunk of debris actually striking a person is about 1 in several trillion.

NASA's falling satellite was originally launched in 1991 to study Earth's ozone layer and upper atmosphere. The satellite was decommissioned in 2005.

According to Space.com, "The sun has had an extremely active week, one that has included several solar flares. High solar activity can cause the Earth's atmosphere to heat and expand, which can increase drag on a low-flying satellite like UARS, making it fall faster."

Causing the Earth's atmosphere to heat? Is that an admission that global warming is not caused by man, but by the sun? - Oooops, sorry, just a thought. . . back to topic:

NASA does not have an exact determination where the satellite will finish its fall from space, but have determined the satellite will probably descend between the latitudes of Northern Canada and Southern South America, a region of Earth that encompasses much of the planet. The expectation is that they will be able to update their predictions with more certainty tonight.

Considering that three-quarters of the planet is covered by water, the likelihood that the satellite, if any of the debris escapes the heated descent, lands in the ocean is likely. But, at this point, where the debris from the satellite lands, if any survives the fiery fall, is anybody's guess.

UPDATE: Satellite may strike tonight, or early Saturday Morning - Southern California may have opportunity to see light show.

"As of 10:30 p.m. EDT on Sept. 23, 2011, the orbit of UARS was 85 miles by 90 miles (135 km by 140 km). Re-entry is expected between 11:45 p.m. Friday, Sept. 23, and 12:45 a.m., Sept. 24, Eastern Daylight Time (3:45 a.m. to 4:45 a.m. GMT). During that time period, the satellite will be passing over Canada and Africa, as well as vast areas of the Pacific, Atlantic and Indian oceans. The risk to public safety is very remote."

UPDATE: NASA said early Saturday it was trying to confirm the crash-landing of the biggest piece of US space junk to fall in 30 years, which was over Canada, Africa and open ocean during the re-entry window.

U.S. hikers Bauer and Fattal are freed by Iran, arrive in Oman

Two American hikers jailed in Iran since 2009 were freed from prison Wednesday and flown to Oman, where they were reunited with joyful family members.

Shane Bauer and Joshua Fattal, both 29, were released Wednesday evening local time after spending more than two years in prison on charges of illegal entry and espionage since they and a companion, Sarah Shourd, were arrested on the border between Iraq and Iran while hiking in the mountainous region. Shourd, who was freed last year and is engaged to Bauer, was on hand in Oman to greet the two as they ran down the stairs from the private plane that picked them up in Iran and flew them to freedom.

The lawyer for two Americans jailed as spies in Iran says a $1 million bail-for-freedom deal has been approved by the courts, clearing the way for the release of the men after more than two years in custody.

“We’re so happy we are free,” Fattal told reporters at Muscat International Airport in Oman.

“Two years in prison is too long,” Bauer said. He expressed hope that Wednesday’s release would lead to “freedom for political prisoners in America and Iran.” After making their brief statements, Bauer and Fattal left the airport with their families.

Queer Circumstances

By Douglas V. Gibbs

The repeal of "Don't Ask Don't Tell" was officially fully implemented a couple days ago. Many people who haven't the slightest clue about military efficiency, or the intricacies of a military unit, much less ever served a day of their life in the military, have been arguing with me, a veteran, over the last couple days over what is best for the military. Collectively, these liberals have determined that the repeal of "Don't Ask Don't Tell" is a good thing, and necessary. After all, the "right" to serve in the military, these people tell me, should not be refused to anyone.

The last time I checked there was no "right" to serve int he military. The military must have the choice on who to accept and reject when it comes to the full efficiency of the fighting units.

Sure, gays are capable of fighting as well as any other member of the armed services. Their abilities are not the problem here. The problem is the overall cohesiveness and effectiveness of the military units, both physically, and psychologically.

"Don't Ask Don't Tell" was signed into existence by President Clinton as a grand compromise. It served to compromise our national security, it served to compromise our nation's identity, and it served to compromise our social morals.

When homosexuals began to form the framework of the modern gay agenda, they taunted marriage, rejected the church, and were staunch anti-military activists. Now, they demand marriage to be redefined to fit their agenda, have infiltrated the church only to convince congregations and denominations to admit gays as members of the clergy, impose themselves into the school system forcing the teachers to teach the gay lifestyle as "normal" (California AB 48), and now it is suddenly important that gays serve in the military with full prancing allowances intact.

I realize that most gays could care less about marriage, serving in the military, and don't wish to give the church the time of day. However, the militant gay agenda has realized that it is politically to their advantage to demand these "rights" in the name of fairness, and protecting the poor prancers from "homophobia" (a term they created themselves to encourage sympathy for their alleged plight).

Conservatives really don't care what you do in your bedroom, and do not believe in passing legislation to control "The Gay." The problem is not your gayness, but the fact that the homosexual lobby is working to change definitions, justify the deviant sexual behavior, and force upon society through unscrupulous means the argument that the sexual deviation is somehow "normal."

As for "Don't Ask Don't Tell," it never had anything to do with the ability of a gay service member to perform his or her military duties. From a military point of view, "open" gayness creates a hazard to the military code of conduct, unit cohesiveness, discipline, and combat readiness. The repeal of "Don't Ask Don't Tell" compromises the complexities of the military model.

Military readiness and discipline is at stake here, and is something not understood by civilians, no matter how much they try. Non-military persons don't understand what it is to be a military member. There is no quick way to explain the process of breaking down a recruit, and reforming him into a fighting machine capable of being a team player with his brothers in the field, while killing the enemy without experiencing severe psychological damage. Training is key, and being able to operate without hesitation is paramount to the survival of the service member, and the members of his unit.

Operational readiness is a combination of training, discipline, and the proper planning by the chain of command to carry out the operation as designed. The variables on the battlefield are constantly changing, so the planning of operations changes as well. A superior unit is able to adjust with these constant changes. A unit that can quickly adjust to the changing parameters of the battlefield situations is one that experiences no distractions, and maintains a brotherhood rooted in the similarity of individual experiences in regards to training, combat history, and unit morale. Who you were, and who you would be if you were not a part of the unit, is something that must be set aside. You are a member of a fighting unit. The weapons, training, and the unit itself is your new identity. You are nothing else - you are an individual cog in a much larger machine, and your individual quirks are best left to the outside world, there is no room for them in combat.

The lack of definable standards aside from unit unity, except as they arise under the changing parameters of the battlefield, is part of the reason that individual differences cannot be embraced. A white service member is not openly white, he is a member of the unit. A black service member is not openly black, he is a member of the unit. A Hispanic service member is not openly Hispanic, he is a member of the unit. An Asian service member is not openly Asian, he is a member of the unit. And so on, and so forth. Those that demand that their differences are entertained become detrimental to the unit's cohesiveness, discipline, and battle readiness. Minor uniqueness may be tolerated, but after all is done and said, the unit is not about any of the individuals, the unit is about the unit.

Such an attitude is necessary if the unit is to survive, and perform successfully during the stresses of battle.

Homosexual members of the U.S. Military, by allowing their gay lifestyle to become common knowledge, pose a significant risk to their unit because, like it or not, the members of that unit are human, and the openness of the lifestyle will create distractions. Don't get me wrong, members know there are currently gay service members around them, but if it is kept mum, somehow that makes it less distracting.

In a perfect world people may be able to look the other way, but in a military unit of men who are supposed to be a cohesive unit that is trained to kill the enemy, the distraction of a unit member that may have sexual attraction to some of the members of the unit creates a number of complex issues that is more likely to weaken the battle readiness of a unit, than to strengthen it. Simply put, those kind of distractions, and unsure feelings about the cohesiveness of the unit, creates hesitation.

And hesitation kills - not just the individual, but members of his or her unit, as well.

The restrictive rules of engagement in place already have our military fighting members thinking more than fighting. Openly gay service members adds on to an already fragile situation. Simply put, forcing the U.S. Military to accept openly gay members, and to allow them to prance around as homosexuals while in uniform, is dangerous, and will prove to be fatal in the long run to a number of military personnel.

Unfortunately, the ability to investigate the concept of homosexual effects on military readiness, and to clarify some of the misconceptions by the civilian world, will be near impossible due to the infiltration of political correctness, and the unwillingness of the brass to properly address this issue. Military capabilities, down the road, will falter, and at that time the leadership will literally ask, "I wonder why?" rather than trace the drop in discipline and readiness to this point in time. Perhaps someday the military will be able to counter the effects of openly gay personnel in the military, but by then, the damage will be done, and our forces will be no more effective than those of European nations. And considering the voracity of the enemy we face, when it comes to the Islamic Jihad, any drop in our capabilities is another notch in the belts of the advancing Muslim cloud of darkness.

Openly gay service members present issues to the present framework and taxonomy of readiness, ultimately compromising our ability to be a superior fighting force. Service members will lose their lives as a result of this dangerous decision. Military readiness already has to battle political correctness, as well as the relationship between budgets and training. To force the units to also accept openly gay members will result in the death of some of our personnel. If the homosexuals truly appreciated our military, they would stand down, and leave their personal temper tantrums behind.

As a side note, Article I, Section 8, Clause 14 tasks the Congress with the authority to make the rules for the government and regulation of the land and naval forces. The courts do not have that authority, so the repeal of "Don't Ask, Don't Tell" through judicial activism is unconstitutional. The repeal through the Congress is the Constitutional path. Or, at least that is what the law says.

A powerful explosion rocked a Michigan street. The blast was caused by a car bomb, seriously injuring a father and his two sons.

Investigators, including members of the Bureau of Alcohol, Tobacco, Firearms and Explosives, have been on the scene working to discover who was behind the blast.

It is unknown if the victims were targeted or whether the attack was random.

The ATF has offered a reward of up to $10,000 for information that leads to an arrest.
