Federal Authority Lacking When States Defund Planned Parenthood

By Douglas V. Gibbs

The headline reads: Judge blocks de-funding of Planned Parenthood in Kansas

The first sentence reads: What flies with the Kansas Legislature doesn’t always fly in federal court.

So, where in the Constitution does it give the federal government the authority over abortion, or Planned Parenthood clinics? And since there is no federal authority, then what is the federal courts doing being involved?

Also, the federal courts are not supposed to negate State laws (yes, that's right, Roe v. Wade was unconstitutional too!).

Reality is, they do it anyway. They took that power for themselves. I call that tyranny.

If Governor Brownback of Kansas was smart, he'd tell the Federal Government to buzz off, and defund Planned Parenthood anyway.

In other words, ignore the federal courts. Technically, they have no authority over the States - especially on an issue like this one. Besides, the courts have no enforcement arm - and if Obama was to force the State to comply, imagine the backlash that would receive.
