A Declaration of War Does Not A War Make

Temecula Constitution Class, June 5, 2014, 6:30 pm.

Article I, Section 8: The Congress shall have Power. . . To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water.

Article II, Section 2: The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States.

Question: Is it illegal for a President to Wage War when the Congress has not Declared War?

Points to Ponder:
1) The Constitutionality of the War Powers Act of 1973.
2) The language of the Articles of Confederation on the matter.
3) The discussion on August 17, 1787 in the Constitutional Convention as recorded by James Madison on the topic.
4) George Washington.
5) The Barbary Wars, our first two international wars, waged during the presidencies of Thomas Jefferson, and James Madison, both without a formal declaration by the United States Congress.
6) The definition of a Declaration of War, and the resulting consequences of battle during both conditions.
