Obamacare: No Mandate, No Constitutionality

By Douglas V. Gibbs

There are no authorities granted by the U.S. Constitution allowing the federal government to stick its nose into the health care issue.  However, in 2015 when the Affordable Care Act's case reached the United States Supreme Court, Chief Justice John Roberts sided with the leftist judges (despite claiming there are no judges who play ideology games) to keep Obamacare on the books, indicating that since a penalty accompanies the mandate requiring one to purchase health insurance, and the penalty (according to Roberts) is a tax (of which Congress is constitutionally authorized to tax you) then that made Obamacare good and legal-like when it came to the U.S. Constitution.

While I disagree with Roberts, because I believe authorities must be expressly enumerated by the Constitution, not twisted through a meat-grinder of interpretation and judicially pliable implied law by a bunch of politically appointed ideologues in black robes, we are in a position where we have to play by the rules they have established.  The problem is, the liberal left doesn't even play by their own rules unless it is to their agenda's benefit.

Their rules dictate that if a judge makes a claim, even if it defies the original text of the U.S. Constitution, the judge must be obeyed and anything to do with the issue involved must stop on a dime.  The Democrats believed that with President Trump's travel restrictions.  The Democrats believed that when President Trump challenged DACA.  The Democrats believe that when it comes to Birthright Citizenship.  The Democrats have even used the courts to challenge Trump's stance regarding limitations placed upon people claiming to be asylum-seekers.

So, why are they so angry when a federal judge has ruled that Obamacare is no longer constitutional because the mandate is no longer a part of the law?  Don't they believe when a judge says something the legal engines regarding the struck down item must come to a screeching halt?

The refusal to accept the judge's ruling on Obamacare reveals what we already knew.  The rules change, in the minds of the Democrats, and only apply when they help their progressive liberal left commie political causes.

The liberal left believes the ends justify the means, and the rules change constantly, and will change constantly, until their policies are the only ones left standing.
