A conservative activist in California says the U.S. Department of Justice has no constitutional authority to investigate whether city officials discriminated against Muslims.
In 2010, the Lomita City Council turned down a request for the expansion of the Islamic Center of South Bay, stating that the extension would create traffic problems. However, the region's Muslim community suspects discrimination and claims that officials are in violation the Religious Land Use and Institutionalized Persons Act (RLUIPA). So the U.S. Department of Justice has stepped in to investigate and has interviewed roughly a dozen individuals.
Douglas V. Gibbs, a conservative radio talk show host and publisher of Political Pistachio, says city officials have a legitimate right to deny such a request.
