Sometimes, I get ideas for articles, and jot some quick notes down because I am not in a position to write out the articles, but I don't want to forget the idea. Then, the notes, when I get home, get placed on a stack on the left side of my desk. Sometimes I use those notes, and sometimes some of them remain on that stack, until much later, possibly years later, I find those notes again.
The following was inspired by one of those old notes.
American Oligarchy and Gay Marriage
The political opinion of a single judge is being elevated above the desire of the populace, in relation to Proposition 8. Apparently, our vote does not matter. But beyond the vote of the people, the ruling screams in the face of the Rule of Law, violating the authorities granted to the federal courts by the Constitution.
Reminds me of the General Will by Jean Jacques Rousseau, where the will of the people is only recognized by the ruling elite, and it is up to the ruling class to force the general will on society, and any opposition must be restrained by the body politic. Men must be forced to be free.
If a single judge is using his own activist opinion regarding a behavioral preference, can overturn the vote of the people, then why are we being told that elections matter? This isn't about rights, it is about destroying an institution, and the opinion about it by the people, to the liberals, is irrelevant.
Looking deeper, remember that civil unions already exist in California, so this gay marriage thing is not about the benefits. It is about marriage, and destroying what marriage stands for.
The message is that the people can't be trusted to define marriage, but a gay circuit judge can be.
