Today's Guest: Arkady Faktorovich, Grew up in the Soviet Union, served as an engineer for the government in the USSR working on Top Secret projects, and he left the Ukraine for the United States in 1978.

A while back I recommended to Arkady a book called "Hamilton's Curse" by Thomas J. DiLorenzo. He called me recently to thank me for recommending such an extraordinary book. Today, I invited Arkady to be on the Constitution Radio program not only to discuss how Hamilton's views are alive and well in the Democrat Party, but how this kind of thinking flourished in the Soviet Union. . .

During the interview I will give the answer to today's Constitution Quest question, as well. Nuts and Nuggets


Nut: Barack Obama after being challenged by a St. Louis Reporter Confronting him about "Jetting Around" on Vacation and Intimidating the Supreme Court

St. Louis, KMOV-TV, Larry Conners interviewed Obama and asked, "The economy is a big issue and concern for folks. I mean, the unemployment, trying to make ends meet, gas prices, food prices going up. Some of our viewers are complaining, they get frustrated, even angered, when they see the first family jetting around, different vacations and so forth, sometimes maybe they think under color of state business and that you're out of touch, that you don't really know what they're experiencing right now."

Obama: I don't know how many viewers you're talking about that say that --

Conners:  We do hear from some.

Obama:  Yeah, I hear from all kinds of --

Conners:  I'm sure you do.

Obama:  -- viewers about everything.  But the fact of the matter is, I think if you look at my track record, I'm raising a family here.  When we travel, we gotta travel through Secret Service in Air Force One.  That's not my choice.  I think most folks understand how hard I work and how hard this administration's working on behalf of the American people.

Is he really working that hard on behalf of the American People, or in opposition to the American People? He’s acting as if these vacations are a part of doing business.  He and his wife take separate planes, even to nearby Martha’s Vineyard maybe a few hours apart, and the American People see this crap.

Then Conners asked a doozy: After the oral arguments in the Supreme Court many were saying the plan's going to be rejected.  You apparently believed enough that you were compelled to say you were confident the Supreme Court would not overturn what the Congress had done.  Critics say that you were using this as a bully pulpit trying to intimidate the justices and you stepped over the line.

Obama:  The reason we give them lifetime tenure is they don't get intimidated, because, you know, they understand that they're immune from those kinds of political considerations.  The point I was making, which is one that I think most legal scholars would agree with, is that although the Supreme Court has the power to overturn congressional laws that violate the Constitution, it would be extraordinary for them to step in and overturn a law dealing with one of the biggest segments of our economy that everybody acknowledges is national in nature, under the commerce clause.  That hasn't been done since before the New Deal.

Really?

Obama:  For the courts to take that step would be extraordinary and I don't think they're gonna take it.

He says he can't intimidate them, and then he intimidates them.  Obama says you can't intimidate the justices. They have a lifetime appointment, out of which they can be removed for bad behavior. The justices are not permanent statues there. He was admonishing the court, and then says he didn’t.  “They won't overturn something this big.” What if they do, Barry? What if they do? Then what are you going to do? Push it through regulatory agencies? Sign an executive order? That’s what he does. He steers around his normally precious courts, acts as if the Congress is there to be his rubber stamp - and if you don’t do what he wants, he threatens you.

That is what authoritarians do.

Nugget: Karl Rove regarding this War on Motherhood that was launched by Hilary Rosen:

Wolf Blitzer on CNN, with Hilary Rosen, talking to and interviewing Hilary Rosen.

Wolf says to Hilary: I see you smiling, but I don't know why you're smiling. How should you have phrased what you wanted to say? Because this was an awful way of saying it. Look into the camera. If Ann Romney is watching you right now, talk to her. I didn't hear an apology. Here's what I don't understand, because you're an excellent and very astute political strategist. Why bring Ann Romney into this conversation? Should conservatives, Republicans, go after Michelle Obama? Democrats are quickly throwing you, as you well know, under the bus.  Democrats are going after you like that.  It's one thing for the Republicans to be slamming you, but for all these Democrats that you have worked so closely with over the years. If someone could organize a little face-to-face time between you and Ann Romney to talk about this in person, that would probably be helpful, don't you think? Hilary Rosen, thanks very much for coming in. Good luck.

The democrat liberals are shocked, not that Rosen said what she said, but that there was such a backlash.

Karl Rove, then, on Fox News with Greta Van Susteren, after Greta asked "She certainly is an experienced mother.  She knows the challenges of raising a family and household.  She's had health challenges.  I didn't see this as an attack personally on Ann Romney, Karl."

Karl Rove:  I think there are people in Chicago who are happy that Hilary Rosen has said this thing and has injected this into the campaign --


Greta Van Susteren:  They've thrown her under the bus already.

Karl Rove:  They should have called up Debbie Wasserman Schultz, the Democratic national chairman, who they instructed to put Rosen in as senior adviser and say publicly fire her as senior adviser, but they don't do that.  Why?  'Cause One of the persons who has -- who has coined the phrase "War on Women" and used it probably more than anybody -- any other public figure is Debbie Wasserman Schultz.  It was personal. It was mean. It was nasty, and her apology is halfhearted.  And I suspect there are guys in Chicago sitting in that headquarters who are saying, "God, we were smart to get that 140-word tweet out, and isn't it great we got our shot in and we were able to distance ourselves with it."

Rove is saying that the democrats wanted Hilary Rosen to say what she said, they believe what she said, but their favorite part is that they got her to say what she said, and then they were able to distance themselves from it. It’s out there, but they are not to blame. Put the ridiculous notion into the voters head, but if there are those that want to accuse the democrats, they are pulling a Bart Simpson: “I didn’t do it!”

Besides, Hilary Rosen is not going to get fired, or anything, over this. She’s one of them. She's involved in Obama's reelection campaign.  This “throwing her under the bus” biz is a dog and pony act. It is strictly for show.
