Obama Campaign Sues to Restrict Military Voting

While Barack Obama and the Democrats like to give lip service to our men and women in uniform, it’s what they do that betrays their rhetoric. He likes to get his picture with troops even though behind closed doors they are giving him the finger and sleeping during his speeches. This all makes things quite interesting when both the Obama campaign and the Democrat party are suing to restrict the military’s ability to vote in the upcoming election.

Breitbart.com reports,

On July 17th, the Obama for America Campaign, the Democratic National Committee and the Ohio Democratic Party filed suit in OH to strike down part of that state’s law governing voting by members of the military. Their suit said that part of the law is “arbitrary” with “no discernible rational basis.”

Currently, Ohio allows the public to vote early in-person up until the Friday before the election. Members of the military three extra days to do so. While the Democrats may see this as “arbitrary” and having “no discernible rational basis”, I think it is entirely reasonable given the demands on servicemen and women’s time and their obligations to their sworn duty.

The National Defense Committee reports:

[f]or each of the last three years, the Department of Defense’s Federal Voting Assistance Program has reported to the President and the Congress that the number one reason for military voter disenfranchisement is inadequate time to successfully vote.

So now we see the Democrat playbook come out again. We see the praise of the lips while they drive the knife into the back of our service men and women that they are using abroad in unconsitutional wars. While I disagree with Mike Flynn that they “have more right to vote than the rest of us,” I emphatically agree that they have the right to vote and that right should be defended by those of us at home.

While Republicans have been battling for Voter ID laws, maybe they should include in that battle protection of the military’s vote.

On Thursday, I broke the news that the Obama campaign had sued the state of Ohio over a provision which gave members of the military three extra days for early voting. The media and the left predictably pushed back aggressively that the Obama lawsuit wasn't intended to target votes of the military. Rather than taking them at their word, my colleague, Joel Pollak documented the sad recent history of Democrats working to suppress the military vote. Today, we bring you evidence, from 2000, of Democrats actively succeeding in disqualifying military ballots.

In 2000, the nation's politics hung in the balance of a recount fight in Florida. George W. Bush had beaten Al Gore by a few hundred votes in the seminal swing state, and Democrats went all-in to reverse this result and hand the presidency to Gore. One of the lawyers hired by the Democrats during the recount fight was Mark Herron, how drafted a memo detailing how to disqualify military absentee ballots. (Memo is below.) His work had an immediate affect, as recalled by Bill Sammon in 2001:

I wasn't going to write about Gabby Douglas and the Monkey commercial because it is such a stupid happening. The uproar, the embarrassment, and the apology all reveals the racist tendencies of the liberal left. I already know that the liberal left democrats are a bunch of racists, so I saw no need to address this issue.

The comments by the liberals in my life over the incident, however, begs for my response.

When I first saw the situation where Bob Costas followed up a Gabby Douglas performance with some words of encouragement to young black girls aspiring to be gymnasts, and then NBC put on a commercial for a new television show on their network with a monkey on some gymnastics rings, I thought to myself: "How exciting that an American gymnast is doing so well. That monkey looks like the one used by the Angels for their 'rally monkey' time. Hmmm, that show does not look appealing to me."

No thought about any connection between the fact that Gabby is black, or the monkey, ever crossed my mind. I just don't think that way. Perhaps spending some of my growing up years in North Long Beach attributes to that. I don't know.

It wasn't until the liberals made such a big deal about it I realized the supposed connection.

In the past racists have made comparisons of primates to blacks, so immediately somebody either felt guilty, or got offended, and the stink rose up.

But isn't it racist to see such a connection in the first place, even if the person feigns embarrassment or disgust over the whole situation? Wouldn't someone that has race on their mind see such a connection in the first place?

The media has also been making such a big deal also of the historic performance of Gabby... because she's black.

Who cares if she is black? I don't mean that in a demeaning way, but that color really shouldn't be an issue. She's an American, and I am proud that a young American woman has done so well in the Olympics. Her skin color didn't even register, and it shouldn't.

Okay, there is no such thing as color blind. If I see a black person, for example, walking down the street, I realize they are black. But it doesn't matter to me. I see people. Americans. Not groups.

I am only prejudiced against jerks and idiots.

Shame on all of those people making a big deal over this monkey commercial thing. It was unintended. It was not meant to be racist. Therefore, it was not racist.

End of story.

Oh, and congratulations to Gabby Douglas for being able to represent her country in the Olympics - as an American.

Unemployment Up, New Jobs Still Down

Unemployment Rate Rises to 8.3 Percent; 163,000 New Jobs Created in July

The seasonally-adjusted unemployment rate in the United States rose to 8.3 percent in July, with the economy adding a net of 163,000 jobs, according to estimates calculated by the federal Bureau of Labor Statistics. The number of jobs added was more than expected, but was not enough to keep up with new entrants into the job market, reinforcing conclusions that the U.S. economy is stagnant. With overall economic growth slowing, weak employment numbers could indicate that the U.S. is following other industrial economies on a downward path back into recession. June's job number was revised down from 80,000 new jobs to 64,000.

Earlier this week, new claims for jobless benefits hadrisen to 365,000--slightly lower than expectations--while the private sector added 163,000 jobs in July, well ahead of expectations but down from the previous month. Manufacturing output fell again in July, after falling in June for the first time in three years. Surveys of economists had predicted that the unemployment rate would remain unchanged at 8.2 percent, with 95,000 to 100,000 new jobs created. It was thought that only a positive, unexpected development could lower the rate. Despite the growth in jobs--the highest in five months--the slow economy could not lower the overall jobless rate.

Cass Sunstein the Latest Radical Marxist to Jump Ship

RADICAL OBAMA REGULATORY CHIEF CASS SUNSTEIN RESIGNS

Cass Sunstein administered the Office of Information and Regulatory Affairs (OIRA). Referred to as OIRA (Oh-eye-rah) in wonky academic circles, it is one of the most powerful behind-the-scenes jobs a person can have because it reviews nearly every regulation for an administrative state that continues to expand.

And on Friday, Sunstein resigned from this post and said he would go back to Harvard, signifying another moment in which a key Obama ally decided it was better to jump ship.

Sunstein once argued in a speech at Harvard that the government could be used to eliminate “practices such as ... meat eating,” argued hunting should be banned (“We ought to ban hunting ... that should be against the law ... it’s time now,” he said), and wrote in a 2004 book that animals should be able to sue in a court of law and have humans represents them as clients.

Few represented President Barack Obama’s academic aloofness and air of intellectual superiority more than Sunstein and Obama essentially asked the radical professor what job he would want in his administration.

Like the Crusaders, Never Submit to Islam

The Muslims call Islam the Religion of Peace. George W. Bush erroneously repeated the lie after 9/11. As far as the Muslims are concerned, someday Islam will indeed be the Religion of Peace. That peace, they believe, will begin on the day when Islam finishes its jihad and all of the people on the planet are Muslim. When the worldwide caliphate exists, it will then be the religion of peace, because there will be no infidels left to slaughter.

Even peaceful Muslims believe in the day of the worldwide caliphate. The moderate Muslim is not as peaceful as they seem, for deep inside they know that if in their lifetime the worldwide dominance of Islam was to take place, they too would be dancing in the street.

We are told that the angry, violent jihadists are only a minority, a radical element of the religion that is no different than the Westboro Baptists are to Christianity. They are nothing more than an anomaly. An unfortunate part of an otherwise peaceful religion.

Humanity wants to believe the rhetoric, the lies. We want to assume that deep down the goodness of these poor people outshines anything some radical sheikh, mullah or terrorist proclaims. We want to believe they want peace, and to live in harmony. We want to believe that, but to believe that Islam is a religion of peace as they proclaim is to live in denial. The vast majority of Muslims, though if they had been born in different circumstances they may very well may have turned out to be a peaceful people, have been conditioned from birth that Islam is superior in ways the Nazis believed themselves to be, and that only conversion to Islam, or death, is acceptable.

The swelling tide of Muslim cultural expansion in the last few decades is alarming. The belief by these people that Islam will dominate the world is something they don't hide. To them, freedom is nothing, for only slavery to Shariah law is the solution.

The followers of what our society calls "Radical Islam" is not just a small percentage. The Muslims that believe in the radical teachings of Islamism are not merely radical fringe groups. The Jihad, though perhaps waged by only a small percentage, is supported by all 1.3 billion Muslims around the world. But even if only 1% engages in Jihad, that is still 10.3 million Muslims.

Nearly 20,000 deadly terror attacks have been carried out worldwide since 9/11 by Muslim terrorists. And these violent attacks are not simply the actions of a fringe element of Islam. Children in Islamic countries are taught violence from a very young age. Television shows in these countries target children, teaching them to be violent warriors for Muhammad. The Muslims are conditioned to hold in their hearts and minds the violence of Jihad, to kill non-Muslims because of the fact that they are not Muslim, and are therefore inferior beings that need only be squashed like inconsequential bugs.

The Koran is the holy book of Islam, written by Muhammad as a new testament of religion. The Koran is said to be filled with words of wisdom on how Muslims should live their lives, and how they should interact with those around them. The Koran teaches Muslims that Jews and Christians are the enemy, that they are blasphemous and unclean beings, which surely must be killed.

"O you who believe! do not take the Jews and the Christians for friends; they are friends of each other; and whoever amongst you takes them for a friend, then surely he is one of them; surely Allah does not guide the unjust people." (Sura 5, verse 51). 

"And the Jews say: Uzair is the son of Allah; and the Christians say: The Messiah is the son of Allah; these are the words of their mouths; they imitate the saying of those who disbelieved before; may Allah DESTROY them; how they are turned away!" (Sura 9, verse 30).

"And the Jews will not be pleased with you, nor the Christians until you follow their religion. Say: Surely Allah's guidance, that is the (true) guidance. And if you follow their desires after the
knowledge that has come to you, you shall have no guardian from Allah, nor any helper."
(Sura 2, verse 120).

"And KILL them (the unbelievers) wherever you find them, and drive them out from whence they drove you out, and persecution is severer than slaughter, and do not fight with them at the Sacred Mosque until they fight with you in it, but if they do fight you, then slay them; such is the recompense of the unbelievers." (Sura 2, verse 191).

"Let not the believers take the unbelievers for friends rather than believers; and whoever does this, he shall have nothing of (the guardianship of) Allah, but you should guard yourselves against them, guarding carefully; and Allah makes you cautious of (retribution from) Himself; and to Allah is the eventual coming." (Sura 3, verse 28).

"And whoever does not believe in Allah and His Apostle, then surely We have prepared burning fire
for the unbelievers." (Sura 48, verse 13).
Jihad is not only a violent means of achieving dominance over the world. Islam also teaches its followers to take over the world through numbers. Immigrate to every major country around the world, having as many children as possible. Eventually, the rising numbers of Islam will stagger the numbers of the enemy, and the world will have only one choice - submit to Islam.

In Mark Stein's "America Alone," the reality is provided in clear detail. In Europe the native population's fertility rate is below two per couple, while Muslim families average between eight and twelve children. "The populations of Europe are aging fast, so more immigrants are needed to support the pensioners, and these will largely be Muslim immigrants."

The Crusades were a response to the growing threat of Islam, but now political correctness and the concept of multi-culturalism is keeping the Europeans from defending their homeland.

More than 50 million Muslims are now in Europe, and by the next generation Islam will have gained control over Europe by pure numbers, without violent jihad, without a single battle being fought. The Europeans will simply be overwhelmed by numbers.

Islam doesn't plan to stop with Europe, however. The goal is to Islamisize every country in the world.

In America Islam has infiltrated Washington DC, but Michele Bachmann's request to investigate the connections with the Muslim Brotherhood have been repelled as hateful and insensitive. Islam has also all but conquered Dearborn, Michigan.

In Washington, DC, there is a group known as As-Sabiqun, and it's leader is Imam Abdul Alim Musa.
His plans and goals are those of most Muslims. "We resolve to shape the ideas, beliefs, and moral viewpoints of the people into an Islamic mold. Toward this end we will, insha'Allah, develop the comprehensive educational system that is necessary to inform, inspire, and direct the society toward Islamic revolution (or evolution). We resolve to utilize all the tools of Islam to develop an analysis and plan of action to totally and completely obliterate the hold of jahiliyyah and enable Islam to take complete control of our lives, and ultimately, the lives of all human beings on Earth."

The opinion of Abdul Alim Musa is not an opinion shared by a "lone radical." His call for dominance is the mainstream view of Muslims around the world. The whole ideology is built around the idea of control, and dominance. The word "Islam" means submission. The goal is to make the entire world eventually submit
to Islam and Allah.

Former Muslims I.Q. al-Rassooli and Walid Shoebat have both told me that all Muslims are potential terrorists. The only possible salvation for them is a change of heart. For many former Muslims that change of heart came with becoming Christians. Regardless, in the end the reality is that they must shed Islam like an old suit. Otherwise, the goal is the same - spread Islam throughout the world, with the specific goal of dominance.

Think about that the next time you hear about a mosque being opened in yet another American city.

Little evidence is available as to why the shooting occurred, but in a Sikh temple near Milwaukee, Wisconsin, a shooter killed six people, four of whom were inside the temple at the time of their murder, and wounded at least three people.

The gunman was killed on site. He shot and wounded one police officer.

The FBI will be taking over the criminal investigation. Motive remains a mystery.

Election 2012 Prepares for the Possibility of Riots

The liberal democrats have fostered an environment of division. They have divided America through their litany of class warfare and calls of racism against all who oppose them. American is pitted against American because the progressives need a crisis to stay in control, and continue through heavy government spending the handing over of power to the international leftists, and global bankers.

Chaos is the crisis they love best, because in chaos the government can justify actions like martial law, and disarming the populace. I am an optimist and I don't believe violence is the odds on favorite, but when one considers the environment that has been created, and consider the reaction we saw regarding the Trayvon Martin case, the violence against supporters of traditional marriage by supporters of the gay agenda, and the stoning of Christians at an Arab festival in Dearborn, Michigan, one realizes that the reality of civil unrest in America over the loss in the re-election of the first black president, and the first radical Marxist president, is all too real.

The Department of Homeland Security and the United States Army are preparing for the prospect of civil unrest as we approach the Republican and Democrat National Conventions, and the 2012 Presidential Election. The Department of Homeland Security has been acquiring hundreds of items of riot gear, and the U.S. Army has also put out the request for riot gear. The gear requested includes riot shields, face shields, batons, and body protection.

The United States Constitution in Article I, Section 8, allows for the Congress "To raise and support Armies, but no Appropriation of Money to that Use shall be for a longer Term than two Years." The reason the army was expected to be funded every two years, as opposed to the Navy which was expected to be maintained indefinitely, was because the founders feared a standing army at the ready under the orders of a central government. They feared that the federal government would use the standing army against the population. Since all bills regarding funding must originate in the House of Representatives, which is populated by direct representatives of the people, the founders felt that was a way to quell the potential for the army being used against the people.

As a further back-up plan, the 2nd Amendment was devised, as a reminder to the federal government that the right to keep and bear arms is a right of the people given by God, and that right "shall not be infringed." With the populace armed, the federal government, the Founding Fathers reasoned, using an armed force against the people was highly unlikely. . . but not impossible.

In addition to the riot gear, the U.S. Government has also introduced drones, the same unmanned aircraft used against terrorists overseas, to the skies above the American landscape. The drones are deadly, and highly efficient in their ability to put down insurgents.

A United States Army Military Police training manual for “Civil Disturbance Operations” outlines how military assets are to be used domestically to quell riots, confiscate firearms and even kill Americans on U.S. soil during mass civil unrest.

Preparations for using troops to deal with mass civil unrest on U.S. soil have been in the works for years, but the crisis the progressives have been waiting for is now on the horizon - it is the 2012 Election Season.

Occupy Oakland Attacks Obama Campaign Office

Between 100 and 200 Occupy protesters marched through downtown Oakland, Calif. Friday night, smashing several car windows and the glass front of President Barack Obama’s local campaign office, according to media reports.

The protesters had taken to the streets after being denied a permit to demonstrate at a monthly art walk, San Francisco ABC affiliate KGO-TV reported.


Several Obama campaign volunteers were working inside the office when the window was smashed with a brick, according to KGO. No one was hurt.

Twitter user David Colburn posted an image shortly after 9:30 p.m. showing a shattered glass window beneath an “Organizing for America” banner, with a large rock or brick still partially lodged inside.

Israel Plans for the Worst as Iran Steps Up Rhetoric

Iranian President Mahmoud Ahmadinejad calling for the destruction of Israel is nothing new. In fact, any leader of a Muslim nation spewing anti-Israel rhetoric has been a normal occurrence since the day Israel became a nation again in 1948. Ahmadinejad in a speech recently, however, upped the ante, proclaiming that the ultimate goal for the forces of the world must be the annihilation of Israel.

Sounding like Adolf Hitler, or any number of anti-Semites, the Iranian president claimed the "Zionists" are the cause of the problems of the world, and that it is because their hands are into everything. They are, according to Ahmadinejad, controlling the world's media and financial systems, and it is the Zionists that decide elections in the United States. Liberating Palestine, which means in his mind for the Palestinians to replace the Jews as the people controlling the Holy Land, would solve the world's problems.

Annihilation of the Jews, claims Ahmadinejad, will bring to the world justice and freedom.

These threats come from the mouth of the President of Iran as the Muslim nation test-fired an upgraded version of its Fateh-110 short-range ballistic missile. The operation was intended to test the missile's ability to hit stationary land or sea targets. The test was a success according to Iran's Defense Minister Ahmad Vahidi.

Iran claims the missile now has a range of "more than 300 kilometres" (190 miles) and can be fired at "targets in the Persian Gulf and Sea of Oman as well as land-based targets." The Iranians are calling the missile a defensive measure, though Ahmadinejad's rhetoric points to an offensive use of the weapon.

As Iran ratchets up their plans for the annihilation of Israel, the violence in Syria has worsened. President Bashar al-Assad's forces have been moving against rebel positions in Syria with heavy artillery, planes and a helicopter gunship, with the most recent target being Syria's biggest city that may determine the outcome of the 17-month uprising.

With the U.N. ceasefire now a distant joke, government forces in Syria battered the city of Aleppo, and the capital Damascus, in a show of force against rebels that has killed about 18,000 people, and may spill into neighboring countries.

Damascus has been spared up to this point during this civil war, and the fighting did not spark in the capital city until July 18 when a bombing killed four of Assad's inner circle. Fighting at that time also erupted in Aleppo.

While the fighting escalates, Russia is sending a group of its naval warships towards the region, with the fleet now moving into the eastern Mediterranean.

Russia claims the warships are not heading towards Tartus, a naval base Russia maintains in Syria. The base is only capable of docking two warships at a time. Later statements have indicated, however, that service boats from the group might call on the small port of Tartus to replenish supplies. The ships are carrying a contingent of about 360 marines and amphibious armored personnel carriers.

There has been speculation that the presence of the Russian ships may be for evacuating Russian citizens out of the area, or for the mere purpose of maintaining a presence in the area. The Russian government has not been privy to giving an explanation. The small size of Tartus discounts the idea that the ships may be present for the purpose of evacuation.

In response to the increasingly unstable situation in the Middle East, Israel has elected to upgrade its top-tier Arrow II missile defense system by improving the system's reach and accuracy. According to Israel's Defense Ministry, they are preparing for possible attacks from Iran and Syria. Arrow is a joint project with the U.S., that is designed to shoot down incoming missiles launched as far away as Iran. In addition to stopping long-range missiles, the system has been also configured to take down projectiles fired from closer range, such as neighboring Syria or Lebanon.

Iran's insistence on building nuclear weapons keeps Israel suspicious, and last week Israeli Prime Minister Benjamin Netanyahu warned that time was quickly running out to stop Iran from achieving nuclear capability.

In addition to the Arrow, Israel developed the "Iron Dome" system to intercept shorter-range rockets that might be launched against Israel by Palestinian and Hezbollah militants.

President Obama's response to the strife in the Middle East has been to wage a culture war on Christians with his contraception mandate, while telling Muslims of the world that the "United States continues to stand with those who seek the chance to decide their own destiny, to live free from fear and violence, and to practice their faith freely."

With the arrival of Ramadan, while undercutting Christianity at home, Obama has been tossing lavish tributes to global Islam as a great and blameless religion.

Obama has also been ignoring questions from Congressmen about Hillary Clinton's aid, Huma Abedin, and her well-documented familial ties to the Muslim Brotherhood. Instead, he has welcomed global Islam's reach into the White House and the State Department. After all, "jihad" is merely a harmless concept of self-improvement, "a legitimate tenet of Islam, meaning to purify oneself or one's community," as Obama security adviser John Brennan has confidently put it.

The Obama administration has refused to identify Islam as a motive for terrorism, while Obama's own press secretary won't even admit that Jerusalem is the capital of Israel. Obama's team, in 2010, even let slip that that they believe NASA's job was to find a way to reach out to the Muslim world and engage much more with dominantly Muslim nations to help them feel good about their historic contribution to science… and math and engineering.

Obama's Ramadan tribute last week made a point of thanking Muslims for their scientific endeavors: "Here in the United States, Ramadan reminds us that Islam is part of the fabric of our Nation, and that -- from public service to business, from healthcare and science to the arts -- Muslim Americans help strengthen our country and enrich our lives."

As Obama has told us, America is not and never will be at "war with Islam."

"I wish Muslims across America and around the world a blessed month, and I look forward to again hosting an iftar dinner here at the White House. Ramadan Kareem," Obama burbled last week.

Netanyahu, and the citizens of Israel, are not willing to be as naive about the intentions of Islam through the hands of people like Ahmadinejad and The Muslim Brotherhood.

Well, in the case of Obama, it might not be naivete, after all.

Being disavowed by your political party is nothing new. It has happened before. A recent example would be from the last election when the Republican Party turned its back on Sharron Angle, Christine O'Donnell, and Joe Miller. These Tea Party inspired candidates were all abandoned by the establishment leadership in the GOP for the crime, in the eyes of the RINOs at the top, for being too conservative.

Tea Party supported candidate Ted Cruz of Texas is beginning to feel the wrath of the Republican Party in this 2012 election season.

The liberal left crazies of the Democrat Party have an even stronger stranglehold on what they consider to be the acceptable ideological stances of their candidates. The collectivists of the Democrat Party demand that all candidates tow the party line, or be not only abandoned, but shunned and attacked as a hateful member of the opposition.

A party like the democrats that is willing to train their foot soldiers to portray conservatives as racists couldn't possibly tolerate any of their own having any conservative tendencies.

Enter into the picture Tennessee candidate Mark Clayton, a democrat with a number of conservative and libertarian views. He won the nomination for the U.S. Senate in Tennessee, pulling off the right to challenge Republican U.S. Senator Bob Corker, but is being disavowed by the Tennessee Democrat Party. Why? He is being accused of being a part of an anti-gay hate group.

Hate group? Oh, you mean that pro-life, pro-marriage group called Public Advocate of the United States?

As a result, the Democrats will refuse to promote him, or support them. He is totally on his own. The Democrat Party is urging the voters to write in candidates other than Clayton.

I guess according to the democrat leadership, you are either 100% for them, or you are to be kicked to the curb.

The Daily Kos called Clayton "anything but. . . a real Democrat."

Clayton said his affiliation with the Public Advocate of the United States was because the group protects “the rights of people who don’t want to live their lives differently.”

The pro-marriage group was labeled as a hate group by the Southern Poverty Law Center, which Clayton says teaches a “gender-bending” curriculum and uses its national list of hate groups as a fund-raising strategy.

So, according to the Clayton Campaign, what are his major positions?

1) Strict adherence to the U.S. Constitution
2) Family stances that are pro-life
3) Keeping the country from turning into “AN ORWELLIAN SUPER STATE.”

He sounds more like a missionary to the heathens of the Democrat Party, doesn't he? Time to maybe slap an "R" after his name.

The local Democrat Party is even now working on a legal maneuver to try to get Clayton’s name off the November ballot, or at least off of the part that says he's a democrat.

The Supreme Court's salvage operation on ObamaCare may have opened up a can of worms. At The Daily Paul, the issue of changing the penalty (for noncompliance with the individual mandate) into a tax (for not owning health insurance) was summed up like this:

According to the United States Constitution, all tax bills must originate in the House of Representatives. This law originated in the Senate, because at the time the Democrats were selling it as a purchase -- not a tax. Since the Supreme Court has ruled that the law is indeed based on a tax increase, it would have had to be initiated as a bill in the House of Representatives.

Consequently, the Patient Protection and Affordable Care Law is unconstitutional on a different criteria than the ones considered by the Supreme Court in this latest landmark decision. By calling the individual mandate unconstitutional but allowing the law as a federal program to be funded by new taxes, Justice Roberts essentially nullified the law.

Actually, the House did originate a health care bill, but it was abandoned. The bill that became law was a "shell bill" out of the Senate. That the Court's ruling created an Origination Clause issue is debatable. (Here are three opinions on the matter from Breitbart, Hot Air, and Newsmax.)

The Court's dissenters in NFIB v. Sebelius addressed the issue of "judicial tax-writing" in Section II, "The Taxing Power" (PDF-pages 142-152). Page 150 (italics added):


For all these reasons, to say that the Individual Mandate merely imposes a tax is not to interpret the statute but to rewrite it. Judicial tax-writing is particularly troubling. Taxes have never been popular, see, e.g., Stamp Act of 1765, and in part for that reason, the Constitution requires tax increases to originate in the House of Representatives. See Art. I, §7, cl. 1. That is to say, they must originate in the legislative body most accountable to the people, where legislators must weigh the need for the tax against the terrible price they might pay at their next election, which is never more than two years off. The Federalist No. 58 "defend[ed] the decision to give the origination power to the House on the ground that the Chamber that is more accountable to the people should have the primary role in raising revenue." United States v. Munoz-Flores, 495 U. S. 385, 395 (1990). We have no doubt that Congress knew precisely what it was doing when it rejected an earlier version of this legislation that imposed a tax instead of a requirement-with-penalty. See Affordable Health Care for America Act, H. R. 3962, 111th Cong., 1st Sess., §501 (2009); America's Healthy Future Act of 2009, S. 1796, 111th Cong., 1st Sess., §1301. Imposing a tax through judicial legislation inverts the constitutional scheme, and places the power to tax in the branch of government least accountable to the citizenry.

But the Court did not actually "rewrite" ObamaCare; the judiciary doesn't do that sort of thing. Indeed, the text of ObamaCare is still the same as it was on May 1, 2010, when last amended. Therefore, we now have a statute in the U.S. Code -- Public Law 111 - 148 -- that the Court has ruled un-constitutional on two counts (the mandate and the Medicaid expansion). And not only that, but the Court's re-rationalization of ObamaCare by converting it into a tax law may have created another constitutional problem involving the Origination Clause. So, in this nation of laws, not men, we have an illegal law on the books.

But that's not unusual. When the Court finds a law unconstitutional, the law isn't automatically stricken from the U.S. Code.

Of Course I'm Intolerant, Aren't You?

So, now that I've endured a week of intolerance at the hands of those who claim to be tolerant, those homosexual activists who are upset that I dared to support Chick-fil-A publicly last week, it's time to have a serious discussion about intolerance.

Yes, I have had to weed through the emails filled with fangs dripping with hate because I simply do not agree that marriage can be redefined on a whim by government. First of all, government does not have that authority in a just society. Secondly, marriage is not the union of man and man or woman and woman. Sorry. But I do so appreciate you intolerant sorts showing how intolerant of other people's beliefs you really are. In fact, I was infinitely more tolerant than you.

Case and point? I said The Jim Henson Company clearly has the right to not deal with Chick-fil-A if it so offends them that the company is rooted in Christian values. Of course, I don't agree with their ideology, but I supported their right to be flaming liberals - literally.

Whereas you hateful, intolerant supporters of homosexual marriage told me over and over again that both I and Chick-fil-A literally did not have a right to stand up for the traditional definition of marriage and Christian values because you simply did not like it. I think the contrast between my tolerance and your "tolerance" is quite clear.

But, what I really want to talk about today is how silly you "tolerant" people preaching against "intolerance" really are. For example, "Intolerance is not to be tolerated and should be done away with!" cried one irate reader of my work. Basically, once you get through the rhetorical loops, this person basically said that intolerance of intolerance is acceptable intolerance. But they also said that their intolerance of intolerance is unacceptable too. Sorry, can't have your cake and eat it too.

Look, I'm proudly intolerant. Intolerance is a good thing I think. Don't agree? Well, maybe you will after you see what it is that I am intolerant of. Just to illustrate, I have compiled a list. It is a partial list, for sure, but still ...

I am intolerant of:

- Bank robbers
- Drunk drivers
- Parents who leave their young children home alone so they can go get drunk/high
- Pot heads who actually think they are not mentally impaired after smoking a joint
- The silly concept of not keeping score because someone's feelings might get hurt
- People on Twitter who think I give a damn what they ate for breakfast
- Rapists
- Child rapists (doubly so!)
- Women who falsely accuse men of rape and people like Jesse Jackson who milk it for all its worth
- Murderers
- People who make excuses for rapists, child rapists, and murderers
- "Low Fat" anything
- People who claim the Holocaust never happened
- Neo-NAZI white supremacists
- Illegal immigrants
- The color puce, because it's hideous!
- Muslim extremists who fly planes into buildings
- Crazy people who claim that Muslim extremists didn't fly planes into buildings on 9/11
- Left leaning "Christians" who try to use Christianity to prohibit liberty, such as the sale of liquor and other items on Sunday
- Telemarketers
- Tomato soup – BLECH!
- Ignorant people who don't realize that corporations don't pay taxes, the consumer does, yet who still call for higher taxes on corporations
- People who think that the 1% are evil simply because they are rich
 -President Obama blaming cops for acting "stupidly" before having any facts in hand
- People who try to disrupt businesses and violate people's rights because they want to "protest" them
- Politicians who think it is okey-dokie to spend our children into debt slavery to pay off political constituents today
- Harry Reid's blithering idiocy
- Nancy Pelosi's ugly mug being shown on television
- 200 lb women who think that they look damn sexy and choose to wear bikinis on the beach to let everyone else know how unsexy they really are
- President George W. Bush for supporting TARP
- President Obama for conveniently forgetting he voted for TARP while blaming its spending on President Bush
- "Conservative" politicians who believe that compromising with liberals actually gets them something they want
- And, most importantly, I am intolerant of people who are tolerant of everything!

Yes, I am proudly intolerant! Aren't you? Ok, maybe not of everything that I am intolerant of, but, come on, at least meet me halfway and say that you are intolerant of murderers and rapists. You can at least agree with me on that right? Come on, I know its hard for you leftists who berate intolerance, but I believe that you can bring yourself to be intolerant of such things.

If you can't, then there is no good that can come from talking to you.

   You quoted the percentage of democrats who are on the goverment handouts.Where did you get your numbers

My Answer:

The reference was in connection with the "pay their fair share" argument. The 40-plus percent was in reference to people who receive entitlements, who also largely do not pay federal income taxes. People on entitlements tend to vote democrat because they want to keep the checks coming in. But if they are worried about people who pay their fair share, then how is it the left justifies over 40 percent not paying federal income taxes?

Now, obviously we all pay some kind of tax, be it property tax, sales tax, etc. The point being made, without splitting hairs, is that while we are being told by democrats the rich don't pay their fair share, a large portion of the democrat constituency pays nothing, or very little, by way of income taxes.

Also understand that I am against a direct tax, and in my opinion the federal income tax should be completely eliminated. However, I brought up the "pay their fair share" issue to show the absurdity of the Left when they whine and cry about equity through taxation, demanding that the rich pay their fair share.

In the end, it is all a Marxist idea. Karl Marx believed that utopia would demand that ultimately the rich would be history, everyone would live communally without a need for money or possessions. To think that a person will give their 100% on a job because of their loyalty to the State over the opportunity to gain profit is absurd. Marxism, or if you want to call it liberalism, fails whenever it is tried. It is a failed ideology. And the strategies they use, such as demonizing profit, and screaming about the rich paying their fair share, is deceptive, and ultimately fails.
